Busia officer commanding station (OCS) and four others have been arrested for defrauding a German national Ksh 2.6 million.
Appearing before the Busia High Court, the court approved the prosecution request to detain the four for 14 days as they complete with their investigations.
“Busia High Court has today allowed the Prosecution application to hold the Busia officer commanding station, his deputy, the petty crimes officer and a businessman for 14 days. The four were arrested and presented in court for defrauding a German national of KSh 2.6 million.

The Prosecution in a miscellaneous application had requested the court for the four, Chief Inspector Wairia (OCS), Inspector of Police Kibelio (Deputy OCS), Corporal Douglas Rono (In-charge petty crimes) and Paul Wanjala (Businessman) to be held in police custody for 14 days to allow investigating officers complete investigations.” said ODPP
The matter has also been referred to another jurisdiction since the respondents are officers of the court.
“The matter had initially been presented before Busia Chief Magistrate but it was later moved to the High Court for directions after the trial court recused itself citing a conflict of interest saying the respondents were officers’ of the court.
Busia High Court Judge Justice W. Musyoka ruled that the four be held at Kakamega police station pending completion of investigations. He also granted the application to have the matter heard in another jurisdiction.
