The Court of Appeal in Nyeri has dismissed an application seeking to impeach Meru Governor Kawira Mwangaza.
The bench headed by Justices Jamila Mohamed, Luka Kimaru and Aggrey Muchelule noted that they lacked the jurisdiction to give direction into the matter.
“This Court lacks jurisdiction in the first instance to consider the merits of the applicant’s application which sought Conservatory Orders before the impeachment process has run its constitutional and legal course,” said the court
They continued by saying that since the process is legal, even if the Governor is impeached, she can move back to the Senate to seek legal redress.
“Even after the Senate makes its decision, the applicant still has the avenue of petitioning the Court for appropriate relief, if the decisions were to go against her. We are, therefore, of the considered view that the applicant’s right to be heard will not be circumscribed,” they said
This is the second time that the Governor has been impeached with the second one attracting all the County MCAs who called out political interference in their decision.
