Court of Appeal declines Former Nairobi Governor Kidero’s plea in EACC probe

The Court of Appeal has declined a petition by former Nairobi Governor Dr. Evans Kidero to block EACC from accessing his bank accounts.

“The Court of Appeal (Musinga, Makhandia & Kantai, JJA) sitting in Nairobi has dismissed a Petition filed by former Nairobi Governor Dr. Evans Kidero seeking to stop EACC from investigating his bank accounts. The judgement was delivered on Friday, 20th September, 2024.” said EACC

In 2016, Kidero moved to High Court to block a similar ruling by the Chief Magistrate that granted EACC the power to investigate his bank accounts that had accumulated a huge wealth majorly during his tenure as the Nairobi Governor.

“Kidero moved to the High Court in 2016 after EACC obtained Orders from the Chief Magistrate’s Court to access multiple bank accounts linked to the Governor on investigations into allegations of corruption, economic crimes and unexplained wealth allegedly amassed during his tenure as Nairobi Governor and Managing Director of Mumias Sugar Company.

In a Judgement delivered on 8th June 2018, the High Court (Odunga, Mwita and Mativo JJ) threw out Kidero’s bid to stop EACC prompting the further appeal to the Court of Appeal.

In his appeal, Kidero had argued that the various sections of the law granting EACC investigative powers were unconstitutional and a threat to his fundamental rights and freedoms.

In effect, the Court of Appeal judgement clears the way for EACC to finalize the investigations. ” said EACC
