High Court orders immediate release of six individuals allegedly abducted

The High Court has on Monday ordered the immediate release of six individuals allegedly arrested by state agencies.

Issuing the orders was Justice Bahati Mwamuyé who also barred the prosecution of the six including Gideon Kibet and Bernard Kavuli until when a case filled by the Law Society of Kenya (LSK) is heard and determined.

According to LSK, the abductees have are being held illegally by the police and other security agencies thus the need to stop further prosecution. The matter had been filed as urgent.

Justice Bahati Mwamuyé also issued orders that the abducted are presented before court on Tuesday 11:00 AM without fail unless a valid reason is given contrary to the orders.

The Inspector-General of Police Douglas Kanja who is also a respondent in the case has also been called to appear before the court to explain the whereabouts of the abducted.

“The rights of the petitioners must be protected, and any unlawful action taken by the authorities must be held accountable,” said Justice Mwamuye.

 The Director-General of the National Transport and Safety Authority (NTSA) George Njao or a designated officer has also been ordered to appear before the court to issued the records of the vehicles that have been linked to the abductions.
