High Court orders Oshwal Academy to allow Muslim students pray

The High Court has ordered Oshwal Academy to allow Muslim students to perform Dhuhr) prayers within its compound.

Issuing the orders was Justice James Wakiaga who noted that a policy introduced by the school back in January 2019 on matters security violated the rights to Muslim students who were at a disadvantage point compared to other learners.

On its part, Oshwal Academy said that they have encouraged integration and cohesion at the school and that the policy was allowed by many parents and only disapproved by a few.

The case had been filed by a former parent who sought to have students enjoy the right to education and freedom to exercise Muslim religion by performing the afternoon prayers as required under Islam.

According the parent, the matter was first raised during a parents meeting in May 2018 to allow Muslim students to pray anywhere withing the school compound, a request that declined by the school management.

The parent continued by revealing that the school further issued terms that included the option to terminate or decline enrolment of a student who will not comply with the conditions.
