Moja Expressway, the company that operates the Nairobi Expressway has been ordered to pay a former employee Ksh 500,000 for using his image without his consent to promote the electronic toll collection (ETC).
Issuing the orders was the date Protection Commission that agreed that the image of one Cyrus Mwaniki Ndung’u was used to promote how one can subscribe and install ETC without his consent.
“In this regard, this office finds that the respondent did not seek consent from the complaint to further process his personnel data after he resigned from employment.” said Data Commissioner Immaculate Kassait.

According to the commission, Moja Expressway used the image for commercial purpose without the consent of Mr. Ndung’u a year after he left the company.
The complaint noted that the case filed on February 2024 suggested that he was still working with the company hence the use of his image to promote the ETC system.
Ngung’u confirmed that he had issued the company a demand letter back in December 2023 but they ignored it only to delete the video on its social media three days later.
