Petition filed challenging Charles Nyachae and Joy Mdivo IEBC chair interview

A petition has been filed in court to bar Charles Nyachae and Joy Mdivo from being interview for the position of Independent Electoral and Boundaries Commission (IEBC) chairperson.

The petition filed by Operation Linda Jamii questions their current positions as public officers and that the interview will be a conflict of interest.

Operation Linda Jami continued by quoting Article 260 of the constitution that prohibits public officers from holding more than one office.

Both Charles Nyachae and Joy Mdivo are chairpersons of the Council of the Kenya School of Government and Kenya Power Board respectively.

At the same time Mdivo serves as the head of United Democratic Alliance (UDA) party at the Electoral Disputes Resolution Committee raising questions into her role if elected chairperson.

“By shortlisting persons who are constitutionally disqualified, the IEBC selection panel has violated the Constitution and the principles of good governance, transparency, and accountability,” read the petition.

Law Society of Kenya (LSK) and Katiba Institute have both been enjoined as interested parties in the case with the intention of ensuring fairness on matters elections.

Nyachae and Mdivo are among eleven candidates who had been shortlisted for the position which fell vacant following the end of then Chairperson Wafula Chebukati term in office.

Other candidates for the position include former Judiciary Chief Registrar Anne Amadi, Abdulqadir Lorot Ramadhan, Edward Katama Ngeywa, Erastus Edung Ethekon, Francis Kakai Kissinger, Jacob Ngwele Muvengei, Lilian Wanjiku Manegene, Robert Akumu Asembo, and Saul Simiyu Wasilwa.
