Kakamega Senator Boni Khalwale through a court order has issued businessman Cleophas Shimanyula Toto 48 hours to apologize and pay Ksh 200 million as compensation.
The Senator noted that failure to comply will see Toto face the law in a suit worth Ksh 500 million.
“Today at the High Court of Kenya, we have given Cleophas Shimanyula Toto 48 hours, within which he should tender an apology for defamatory allegations against me & pay a compensation of Ksh 200 million. Failing which he will face a suit of Ksh. 500 million in the High Court.” said Khalwale

The allegations made by the businessman saw DCI homicide detectives conduct a thorough investigation to establish the cause of death of the Senator’s farmhand Kizito Moi.
A second postmortem was also conducted on the body of the fighter bull trainer, results which confirmed that he indeed succumbed to bull attack as confirmed initially by Khalwale when breaking the news.
Speaking on Wednesday was Khalwale’s lawyer Danstan Omari who warned the businessman against facing other consequences if he fails to apologize and pay the compensation as requested by his client.
“We have firm instructions to file Court Proceedings against you without any further reference to you. This shall of course be at your own peril as to costs on a full indemnity basis and other consequences attendant thereto,” he said
