Supreme Court of Kenya suspends Court of Appeal ruling on Finance Act 2023

The Supreme Court of Kenya has suspended a Court of Appeal ruling the declared the Finance Act 2023 unconstitutional.

The news follows a successful application made against the Court of Appeal decision filed by the CS of National Treasury and Planning John Mbadi alongside four other government officials.

Recently, the controversial Finance Bill received a major recent resistance from Kenya who held countrywide demonstrations before it was pulled down by President William Ruto.

Despite its fall, the government raised questions over the inability to raise the required taxes required for the daily operation of the country thus the need to revise some of the portions.

The Supreme Court noted that the portions need to be reviewed one by one so as not cause disruption of public administration by the government.

“The conservatory orders are necessary to avoid potential operational disruptions in government activities,” said the Supreme Court
